Terms & Conditions

1. Definitions

• "Platform" – the EduMock website, web application, APIs, and all related services.
• "User" / "you" – any individual who registers for or accesses the Platform.
• "Content" – all text, questions, answers, explanations, study materials, PDFs, AI-generated outputs, and other materials available on the Platform.
• "Subscription" – a paid plan granting access to premium features of the Platform.
• "AI-Generated Content" – exam questions, summaries, analyses, and recommendations produced using artificial intelligence models.

2. Eligibility

• You must be at least 13 years of age to use the Platform.
• Users between 13 and 18 years must have the consent of a parent or legal guardian, who accepts these Terms on their behalf.
• By using the Platform, you represent and warrant that you meet the above eligibility requirements.
• EduMock reserves the right to verify eligibility and terminate accounts that do not comply.

3. User Accounts & Registration

• You must provide accurate, current, and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• Only one account is permitted per individual. Creating multiple accounts to circumvent restrictions is prohibited.
• You must notify us immediately at help@edumock.in if you become aware of any unauthorized use of your account.
• EduMock shall not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscriptions & Payments

• Access to premium features requires a paid Subscription processed through authorized third-party payment gateways.
• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise.
• Subscriptions may be set to auto-renew. You may cancel auto-renewal at any time through your account settings.
• EduMock reserves the right to modify pricing with reasonable prior notice. Continued use after a price change constitutes acceptance.

5. Intellectual Property Rights

5.1 EduMock's Intellectual Property

All Content, software, design elements, source code, trademarks, service marks, trade names (including "EduMock"), logos, and AI-Generated Content on the Platform are the exclusive intellectual property of EduMock / Rahul Pawar, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Information Technology Act, 2000, and all other applicable Indian and international intellectual property laws. Unauthorized reproduction, distribution, modification, public display, reverse engineering, or commercial exploitation of any Platform Content is strictly prohibited and will be prosecuted to the fullest extent of applicable law.

5.2 User-Uploaded Content

You retain ownership of materials you upload to the Platform ("User Content"). By uploading, you grant EduMock a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute your User Content solely for the purpose of operating the Platform. You represent and warrant that: (a) you own or have all necessary rights to the User Content; (b) your User Content does not infringe the intellectual property or other rights of any third party; and (c) you have obtained all necessary consents and permissions.

EduMock assumes no liability for copyright infringement or any other intellectual property violation contained in User Content. You shall indemnify EduMock for all claims arising from your User Content.

5.3 Copyright Infringement Notice

EduMock respects intellectual property rights and complies with the Information Technology Act, 2000 (Section 79). If you believe any Content on the Platform infringes your copyright, send a written notice to our Grievance Officer at help@edumock.in including: (a) your contact details; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and its location on the Platform; and (d) a statement of your good-faith belief. We will investigate and take appropriate action within 30 days.

6. AI-Generated Content Disclaimer

EduMock uses artificial intelligence technologies, including models provided by third-party providers such as OpenAI and Google, to generate exam questions, summaries, performance analyses, and other educational content. You expressly acknowledge and agree that:

• AI-Generated Content may contain errors, inaccuracies, outdated information, or omissions, and is provided strictly for educational practice purposes.
• EduMock does not guarantee the accuracy, completeness, currency, or fitness for any particular purpose of AI-Generated Content.
• AI-Generated Content does not constitute professional, legal, financial, or any other form of advice.
• EduMock does not guarantee that AI-generated exam questions will appear in, or are representative of, any actual examination.
• EduMock is not affiliated with, endorsed by, or connected to any official examination authority, including but not limited to SEBI, NISM, UPSC, CBSE, NTA, IIT, NIC, or any government body.
• You should independently verify all AI-Generated Content against official sources and syllabi before relying on it.
• Use of EduMock does not guarantee success in any examination.

7. Acceptable Use Policy

You agree not to:

• Reverse engineer, decompile, disassemble, scrape, or extract data from the Platform by automated means.
• Use bots, scripts, crawlers, or other automated tools to access, query, or interact with the Platform.
• Share, sell, or transfer your account credentials to any third party.
• Attempt to gain unauthorized access to any portion of the Platform, other accounts, or related systems.
• Upload content that infringes intellectual property rights, is defamatory, obscene, illegal, or harmful to minors.
• Circumvent, disable, or interfere with security features or access controls of the Platform.
• Use the Platform for any commercial purpose — including reselling access, content, or exam questions — without express written authorization from EduMock.
• Violate any applicable local, state, national, or international law or regulation.

8. Third-Party Services

The Platform integrates with and relies upon third-party services including but not limited to: cloud storage (Cloudinary), artificial intelligence APIs (OpenAI, Google Generative AI), database providers, and payment gateways. These third-party services operate under their own terms of service and privacy policies. EduMock is not responsible for the availability, accuracy, security, or practices of any third-party provider.

The Platform may contain links to external websites. EduMock does not endorse and is not responsible for the content or privacy practices of any third-party websites.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, OR UNINTERRUPTED AND ERROR-FREE OPERATION. EDUMOCK EXPRESSLY DISCLAIMS ALL WARRANTIES THAT:

• THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS;
• ANY CONTENT, INFORMATION, OR RESULTS OBTAINED THROUGH THE PLATFORM WILL BE ACCURATE OR RELIABLE;
• DEFECTS OR ERRORS IN THE PLATFORM WILL BE CORRECTED;
• THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW:

• (a) EDUMOCK, RAHUL PAWAR, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• (b) IN NO EVENT SHALL EDUMOCK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO EDUMOCK IN THE TWELVE (12) CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE PAID NOTHING, EDUMOCK'S LIABILITY IS LIMITED TO INR 100 (ONE HUNDRED RUPEES).
• (c) THE FOREGOING LIMITATIONS APPLY TO ALL CAUSES OF ACTION IN THE AGGREGATE, WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE, AND SHALL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

11. Indemnification

You agree to defend, indemnify, and hold harmless EduMock, Rahul Pawar, and their respective affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms or any applicable law; (b) your User Content; (c) your use of the Platform, including any AI-Generated Content you rely upon; or (d) your violation of any third party's rights.

12. Suspension & Termination

EduMock reserves the right to suspend, restrict, or terminate your account and access to the Platform at any time, with or without cause, and with or without prior notice. Grounds include, without limitation, violation of these Terms, fraudulent activity, non-payment, or any conduct harmful to EduMock or other users.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 6, 9, 10, 11, and 14.

13. Force Majeure

EduMock shall not be liable for any failure or delay in the performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, floods, fires, earthquakes, epidemics, pandemics, government actions, strikes, internet outages, or failures of third-party service providers.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict-of-law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of Maharashtra, India. Before initiating legal proceedings, the parties agree to attempt resolution of any dispute through good-faith negotiation for a period of 30 days.

15. Grievance Redressal

In accordance with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, if you have any grievance regarding the Platform, its Content, or these Terms, please contact our designated Grievance Officer:

We will acknowledge your grievance within 24 hours and endeavour to resolve it within 30 days of receipt.

16. Changes to These Terms

EduMock reserves the right to modify or replace these Terms at any time. Material changes will be indicated by updating the "Last Updated" date at the top of this page. We may also notify registered users by email. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

17. Miscellaneous

• Severability: If any provision of these Terms is held unenforceable or invalid, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and EduMock regarding the Platform and supersede all prior agreements and understandings.
• No Waiver: EduMock's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without EduMock's prior written consent. EduMock may assign its rights without restriction.
